Pratima Devi vs State Of UK & Others on status of Gorkha OBC

Uttaranchal High Court Km Pratima Devi vs State Of Uttarakhand & Others on 15 October, 2014 WPSS No.1680 of 2014 Hon'ble Sudhanshu Dhulia, J. Mr. Prashant Khanna, Advocate present for the petitioner. Mr. Vikas Pandey, Brief Holder has accepted notices on behalf of all the respondents. Petitioner claims to be a member of OBC community of "Gorkha" which is notified as an OBC in the State of Uttarakhand. However, she is not being treated as such for the reason that for the appointment as an Assistant Teacher in primary school, she has submitted her Caste certificate belatedly. Counter affidavit be filed by the respondents within three weeks. Petitioner may file rejoinder affidavit within three weeks thereafter. List this petition after seven weeks in the daily cause list. Meanwhile, as an interim measure, it is provided that one post of Assistant Teacher in primary school shall be kept vacant for the present petitioner. Interim relief application stands disposed of accordingly. 

Veena Sharma vs Hemlata & Others on 23 September, 2014 
Yet, the Election Petition was filed by Smt. Hemlata on the ground that Smt. Veena Sharma, procuring a false caste certificate claiming herself to be the Hindu Gorkha/OBC Caste, contested the election because such election could have been contested only by a reserved candidate of such caste. The Election Petition was filed by Smt. Hemlata on 29th May, 2013 challenging the election of Smt. Veena Sharma, who put her appearance before the Tribunal/Court after more than three and an half months of the institution of such petition. The ongoing hearing of Election Petition was tried to be hampered by the winning candidate for one reason or the other, inasmuch as, WPMS No. 1236 of 2014, was filed before the High Court which was disposed of by the order
